Refugees and Asylum

Refugee crisis is global as a growing number of countries in the world are experiencing a continuous surge in refugee claims. Canada is one of the most preferred destinations for refugees due to the protection that they get from the federal government, and the support that they from different government agencies to help them resettle in Canada as a refugee.

Canadian Immigration defines Refugees as people who have fled their countries because of a well-founded fear of persecution and are not able to return home due to the many horrors that they have seen or experienced. A refugee is different from an immigrant. An immigrant is a person who chooses to settle permanently in another country. Refugees are forced to flee.

The Canadian refugee system has two main parts:

• the Refugee and Humanitarian Resettlement Program, for people who need protection from outside Canada and
• the In-Canada Asylum Program for people making refugee protection claims from within Canada

Under the Refugee and Humanitarian Resettlement Program, the United Nations Refugee Agency (UNHCR), along with private sponsors, identifies refugees for resettlement. Canadian Immigration does not allow a person to apply directly to Canada for resettlement. Only individuals identified by UNHCR and private sponsors are considered for resettlement and it takes a considerable amount of time to process the cases.

The In-Canada asylum program provide refugee protection to people in Canada who:

• have a well-founded fear of persecution or
• are at risk of torture, or cruel or unusual punishment in their home countries

There are certain criteria that must be met to be eligible to seek asylum in Canada. People who have been convicted of serious criminal offences or have had previous refugee claims denied by Canada are not eligible to seek asylum in Canada.
